1. Overview

NoFap.io ("we," "our," or "us") respects the intellectual property rights of others and expects users of the NoFap.io mobile application (the "App") and website at nofap.io (the "Website") to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, we will respond to clear notices of alleged copyright infringement that comply with this policy.

This policy describes how to notify us if you believe your copyrighted work has been copied or used in a way that constitutes infringement, and how to respond if your material has been removed in error.

2. Reporting Copyright Infringement (Takedown Notice)

If you are a copyright owner, or authorized to act on behalf of one, and you believe that material available through the App or Website infringes your copyright, you may submit a written notification to our Designated Copyright Contact (see Section 5). Your notice must include substantially all of the following, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notification.
  3. Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to permit us to locate it (for example, the URL or a precise description of where it appears).
  4. Information reasonably sufficient to permit us to contact you, such as your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

Upon receiving a valid notice, we will remove or disable access to the allegedly infringing material within a reasonable time and, where appropriate, notify the party who provided that material.

3. Counter-Notification

If you believe that material you posted or provided was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Designated Copyright Contact. In accordance with 17 U.S.C. § 512(g), your counter-notification must include substantially all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before it was removed or disabled.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original takedown notice or an agent of that person.

If we receive a valid counter-notification, we may restore the removed material in 10 to 14 business days after receipt, unless the original complaining party first notifies us that they have filed an action seeking a court order to restrain the allegedly infringing activity.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, access for users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or remove any material that infringes or appears to infringe the intellectual property rights of others.

6. Misrepresentations

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Do not make false claims. If you are unsure whether material infringes your copyright or whether it is protected by fair use or other exceptions, you may wish to seek legal advice before submitting a notice or counter-notice.

7. Changes to This Policy

We may update this DMCA / Copyright Policy from time to time. Any changes will be reflected on this page with an updated "Last updated" date. This policy is part of, and should be read together with, our Terms & Conditions DMCA Policy and Privacy Policy.
